Abstract and Keywords

This chapter discusses the four dimensions of international court (IC) effectiveness: (i) case-specific effectiveness, (ii) ergaomnes effectiveness, (iii) embedded effectiveness, and (iv) effectiveness in developing international law or norm-development effectiveness. Case-specific effectiveness evaluates whether the litigants to a specific dispute follow the orders and provide the remedies that a court awards. Ergaomnes effectiveness assesses whether IC rulings have systemic precedential effects that influence the behavior of all states subject to a tribunal’s jurisdiction. Embeddedness effectiveness evaluates the extent to which ICs anchor their judgments in domestic legal orders, enabling national actors to remedy potential treaty violations at home and avoid the need for international litigation. The effectiveness in developing international law or norm-development effectiveness considers how IC decisions contribute to building a body of international jurisprudence.
